Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DeskAI service. By using DeskAI, you agree to these Terms.

1. Who we are

DeskAI is a service operated by Little Stone Haven ("we", "us"), located in Australia. Contact: privacy@deskai.com.au.

2. What DeskAI does

DeskAI is an AI-powered SMS receptionist. When configured, it receives SMS on your behalf, replies conversationally, books and updates appointments in your calendar, and notifies you of activity that needs your attention. It is a tool that operates on your behalf — not a substitute for your own judgement about your business.

3. Your account

• You must provide accurate information when signing up, and keep it current.
• You are responsible for anything that happens under your account, including anything your AI assistant says to your customers on your behalf.
• You must configure the AI's rules, prices, and schedule accurately. DeskAI answers based on the information you supply.

4. Acceptable use

You may not use DeskAI to:

• Send unsolicited marketing SMS (spam) or violate any anti-spam or telemarketing law applicable in your jurisdiction.
• Impersonate another person or business.
• Facilitate illegal activity, harass individuals, or send content that is unlawful, threatening, or harmful.
• Interfere with the service, reverse-engineer it, or attempt to gain unauthorised access.

5. AI-generated content

DeskAI uses large language models to generate replies. AI replies are not guaranteed to be accurate — you are responsible for reviewing AI activity in your dashboard and correcting anything that misrepresents your business. Features like Review Mode allow you to approve replies before they send.

6. Fees and payment

Subscription pricing, message allowances, and billing terms are set out on your plan page at signup. Fees are charged in advance. You can cancel at any time; cancellation stops future charges and takes effect at the end of the current billing period. We do not offer refunds for partial periods unless required by law.

7. Third-party services

DeskAI relies on third-party providers (Twilio for SMS, Anthropic for AI, Google for calendar integration, AWS for hosting). Their outages may affect the service. We work to route around them when we can but do not guarantee uninterrupted service.

8. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms, fail to pay, or that we reasonably believe pose a risk to other users or to us. On termination, we retain data as described in our Privacy Policy.

9. Warranties and liability

DeskAI is provided "as is". To the extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. Our total liability to you for any claim arising out of the service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

10. Governing law

These Terms are governed by the laws of Australia. Disputes will be resolved in the courts of Victoria, Australia unless another forum is required by law.

11. Changes to these Terms

We may update these Terms. Material changes will be notified by email and reflected here at least 30 days before they take effect for existing customers.
